EPF Withdrawal New Rules

Day by day, the EPF Withdrawal Rules are becoming very much restricted. The EPF organization has updated the withdrawal rule of EPF Balance which is, an employee can’t withdraw 100% corpus before retirement at any situation. Even if, you have resigned or are going through unemployment situation, then also, can’t withdraw 100% balance from the EPF account.

The purpose of this new rule is helpful for retirement saving of employees on long term basis. Also, there are some important changes have done in EPFO for employees as follows.

  • The Retirement age is increased from 55 to 57.
  • EPF amount can’t be withdrawn before the 57 age at the job.
  • EPF membership is not finished with leaving the job
  • 100% EPF corpus amount withdrawal is not allowed before the retirement

Increase of Retirement Age limit

Previous Rule: Till today, the minimum retirement age limit for EPF withdrawal was 55 years. You were able to withdraw the 100% EPF corpus amount after the retirement at the age of 55. This withdrawal rule was beneficial for those employees who prefers early retirement.

New Rule: But, now you would not be able get the entire EPF balance corpus amount before the retirement at the age of 58 years.

Increasing the Age Limit For 90% EPF Amount Withdrawal

Previous Rule: Till today, 90% EPF corpus amount can be withdrawn at the age of 54. Through this rule, an employee can get the opportunity to plan the early retirement before the actual age of retirement.

New Rule: But as per new updated rules, your age must be at least 57 to withdraw 90% EPF corpus amount. You won’t be eligible for this withdrawal facility before 57 and the main purpose of this withdrawal rule of EPFO is to keep the EPF amount for the old age days.

Case Studies

After 15 years in the job, one employee left the company in November 2014 and got entire EPF corpus amount in January 2015. But, If the employee would have left the job after 10 Feb 2016, he couldn’t get 100% EPF corpus amount. Some of his corpus amount would have been in the EPF account till 2038 (his age would be 57 years).

PF Withdrawal after Leaving Job

Old Rule: You can withdraw full EPF corpus amount after leaving the job or being unemployed for minimum 2 months.

New Rule: The recent notice clearly states that you would not get the employer part of the EPF contribution and interest before retirement. This amount would be given only after the retirement.

An EPF corpus has following four parts.

  • Employee Contributed amount
  • Employer Contributed amount
  • Interest on employer contributed amount
  • Interest on employee contributed amount

Besides this, there is a pension scheme available to keep the pension amount separately. The EPF contribution amount is fixed on the basis of percentage, such as 12% EPF on basic salary plus DA which is completely included in EPF fund and 12% of the basic salary plus DA will be contributed from the employer. But 8.33% amount of the employer’s contribution will be used for employee pension scheme. The pension contributed amount can’t go beyond INR 1250/month. The remaining amount will be included in employee provident fund.

Due to deduction of the pension part, the EPF amount of the employer’s contribution is lesser than the employee’s contribution. This EPF contributed amount by the employer is not granted to withdraw before the retirement period.

EPF Subscription Continues

Previous Rule: Till now the EPF subscription was related to the employment. Once you become a member of EPF through the joining of a new job. Once you will leave the job and withdraw your entire EPF Balance, the subscription will be ended.

New Rule: But, now your subscription will be continued up to the retirement age limit 57. Ultimately, the EPF membership is not dependent on the job.

As per the latest news, the EPFO is trying hard to end the dependence of EPF subscription on the employment after leaving of the job. The Universal Account Number (UAN) has already ended the exclusive right of the employer. Through UAN, you don’t have to submit KYC in every new job. If you will link the Aadhaar Card with UAN, you do not need employer’s attestation for withdrawal of EPF.

    I am in UK through my India employer and planning to switch to a local employer in UK.
    Thereby, it will be infeasible to transfer the PF to new employer in UK.
    I will be turning 43 next year and want to know if on resignation, I am allowed to withdraw the full PF and Gratuity?
    The PF accumulated is around INR 7.56 lacs and Gratuity is around INR 1.75 lacs, am I permitted to withdraw this full amount at one go next year and is there any tax applicable in that case?
    If yes, what is the tax percentage?

    I have to withdraw my PF.
    I have completed my 5 years of service. I recently Join new company. Should I mark exit first and then transfer the amount to new PF account and claim for With drawl ? Or Claim for partial amount from previous PF account first and transfer the remaining account to current PF account ? Which will be best option ?
    The requirement is to with draw max PF amount.
    Also under which condition I can get my max PF amount which should be non-taxable. I want to purchase a property. I am seeing an option of PF Advance under Form 31
    Note – I do not want taxable with draw.

    I have left my previous organization and submitted the UAN to the current employer but then too they have generated my new UAN number. Due to which below two issue has been raise:

    1) Two UAN are currently active.
    2) In the PF transfer search by mistake I have raised PF withdrawal request online from my previous employer and now I want to cancel the same.

    how these two issues can be resolved

    dear mam, i updated my aadhaar online in that while filling the detail of idetification then i used voter card detail in which asked me to fill c/o,s/o,w/o then i chose s/o then wrote my father name. now I am asking that I filled my father name that is right or wrong.
    I mean there is not asked my name,,, and option were c/o,s/o,w/o that’s why I chose s/o. I think it is right.
    so please confirm me.

    Respected sirs,
    My total PF experience will be 36 + years with more than five organisations. I submitted the relevant employment changes document in every occasion. But noted only present organisation account details available. All old PF details not seems to be updated even after I have given all thro my present employer properly. My PF UAN No;100303546794.It will be helpful for me the updations.

    I left job on 3.9.2013 & superannuated at the age of 58 yrs. in Dec.13.The pension has started w.e.f. Dec.13.
    So far i have not withdrawn the epf contribution.Need to know about
    1. How long the a/c can continue post retirement?
    2. As inoperative accounts will earn interest now ,will this be applicable to my account ?
    3.Currently i am working as consultant & not contributing to pf.

      Name correction process is- Make a joint request (Employer + Employee) for the said change along with a document confirming the change (PAN, Passport etc) duly attested by the employer and the member. The letter from the employer should have company’s letter head. Submit them to the PF office.

    Recently I saw a press wherein it was mentioned that for availing EPF pension the age of the employee is increased to 60 years from the previous 58 years. In then case, the amount of pension will also increase. Where can I find the details please.

      You can defer your pension only till the age of 60. If you opt for deferment, the pension would increase by 4% for every deferred year.

      You can still withdraw it. Submit relevant Claim Forms duly attested by your ex-employer. No need for attestation if you have your UAN activated and linked to Bank Account & Aadhaar Card.
